In April 2021, the European Commission proposed new brand rules to regulate the use of generative AI in the EU. The offer aims to clarify the legal frame for the use of copyrighted workshop generated by AI and to insure that generators are fairly compensated for their work.
The proposed rules would grant brand protection to workshop created by generative AI, as long as they meet the legal criteria for originality and creativity. The rules would also fete the rights of mortal generators involved in the development of the AI system.
Under the offer, AI- generated workshop would be treated also to workshop created by humans. still, if an AI system is used to produce a work in the course of someone’s employment, the employer would be considered the first proprietor of the brand, unless else agreed upon in a contract.
The proposed rules would also establish a new obligatory exception to brand for the use of copyrighted workshop for textbook and data mining( TDM) by exploration associations. This exception would allow experimenters to use copyrighted workshop to train and test AI algorithms without the need for previous authorization from the brand holder.
The proposed brand rules for generative AI are still subject to farther debate and concession within the EU before they can be espoused and come law.
